Pool owners need to be aware of the new Queensland Pool Safety Laws brought into effect from 1 December 2015.   All pool owners must comply with the pool safety standard prescribed in the Queensland Development Code Mandatory Part 3.4, or run the risk of fines and penalties being imposed upon them.

Previously only new pools or pools that were sold or leased had to comply with the pool safety standard. The only change from 1 December will be that all regulated pools must now comply.  Portable pools and spas capable of being filled with 300 millimetres or more of water also have to comply.

While all regulated pools must comply from 1 December, the requirement for a pool safety certificate still only arises in the event of sale or lease.   Queensland Government legislation permits local councils to issue on-the-spot fines of over $800 to owners of pools which are non-compliant. The maximum penalty for non-compliance is $19,437.
