From December 1, 2014 the Queensland Government will be reducing red tap for property agents with the passing of industry specific legislation to replace the Property Agents and Motor Dealers Act 2000.
The old Act will be replaced with four industry specific Acts:
• Property Occupations Act 2014
• Motor Dealers and Chattel Auctioneers Act 2014
• Debt Collectors (Field Agents and Collection Agents) Act 2014
• Agents Financial Administration Act 2014.
The start of industry specific Acts will bring changes to licensing and operational processes for businesses in the property industry.
Some of the key changes for the property industry under the Property Occupations Act 2014 include:
• Changes to licensing types;
• Streamlining home sales contracts and statements;
• De-regulation of real estate commission cap;
• De-licensing of property developers;
• Changes to the cooling-off period;
• Banning advertising of auction prices;
• A reduction in the number of forms.
Ultimately the process of these new Acts will create a much simpler, easier and smoother process in the property industry that we are all excited to embrace.
